What Should an Employee Do After Receiving a Charge Memo?


A charge memo should not be answered casually. The written reply can affect the entire disciplinary proceeding and may later be examined by the inquiry officer, disciplinary authority, Kerala Administrative Tribunal or High Court.


First, read the charge memo carefully. Identify every charge, the factual allegations, the rules allegedly violated, the documents relied upon and the deadline for submitting your reply.


Every material allegation should be answered separately and specifically. A general statement that “all allegations are denied” may not provide an effective defence. At the same time, avoid unnecessary explanations, emotional statements or expressions such as “please excuse the mistake,” which might be treated as an admission of guilt.


The reply should contain only what is necessary. Do not volunteer unrelated information or accept responsibility without understanding the possible consequences. If an allegation is incorrect, deny it clearly and support the denial with available records.


The charge memo should also be examined for possible legal and procedural defects, including:


- Lack of authority to issue the memo

- Vague or unsupported charges

- Failure to provide essential particulars

- Non-supply of relied-upon documents

- Violation of the applicable service rules

- Unreasonable or prejudicial delay

- Language indicating that guilt was predetermined


These objections must be raised carefully. Poorly framed objections—or failure to raise them at the proper stage—may weaken a later challenge to the disciplinary proceedings.Do not ignore the deadline.


Since the reply may have consequences at later stages of the proceedings, it is useful to have the charge memo and proposed response reviewed by someone familiar with service law. This can help identify relevant procedural issues and avoid unintended admissions before the reply becomes part of the official record.
